29 CFR 1910.95(g)(5)(i): Within 6 months of an employee's first exposure at or above the action level, the employer shall establish a valid baseline audiogram against which subsequent audiograms can be compared: On or about September 14, 2023, at a facility located at 3131 Market Street in Green Bay, WI; the employer did not establish a valid baseline audiogram for an employee exposed to noise exceeding 85 dBA as an 8-hour time-weighted average (TWA).

29 CFR 1910.212(a)(1): One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.: On or about September 14, 2023, at a facility located at 3131 Market Street in Green Bay, WI; the employer did not provide one or more methods of machine guarding to protect employees from caught-between hazards posed by the lowering of the Pioneer Systems Hydraulic Container Dumper (Model HD-48, S# 21240). Employees were not prevented from entering or reaching under the bucket of the dumper as it lowered either from the loading position or from between the frame sides of the dumper.
