29 CFR  1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition.  a) Building 3 Liquid Compounding Room; On or about August 30, 2023, employees were exposed to trip hazards, in that the working area adjacent to the scale areas were blocked by exposed hoses, and puddles of chemicals, while employees batched chemicals.

29 CFR  1910.28(b)(1)(i)(A): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a standard guardrail system.  a) Building 3 Mezzanine Area; On or about August 30, 2023, employees were exposed to fall hazards over 4 feet, in that an adequate standard guardrail system i.e. Compounding flip gate was not in working condition, while compounders transfer chemical totes.  b) Building 3 Liquid Compounding Room Mezzanine Area; On or about August 30, 2023, employees were exposed to fall hazards over 4 feet, in that an adequate standard guardrail system i.e. Compounding dual swing gate was not in working condition, while compounders batched chemicals.  c) Building 3 Liquid Compounding Room Mezzanine Area; On or about August 30, 2023, employees were exposed to fall hazards over 4 feet, in that an adequate standard guardrail system i.e. Compounding dual swing gates were open, while compounder batched chemicals.

29 CFR  1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  a)  Building 3 Liquid Compounding Room; on or about August 30, 2023, employees were exposed to respiratory hazards, in that the employer did not ensure employees who batch using chemicals, such as but not limited to Hydrochloric Acid and Hydrogen Peroxide, use personal protective equipment, such as but not limited to a full-face respirator.

29 CFR  1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a) Building 3 Liquid Compounding Room; On or about August 30, 2023, compounders were exposed to chemical burns and eye and skin irritations, in that the emergency eye and body wash stations were not accessible, in that a, rope, bucket, cardboard and a ladder were stored in or around the stations, blocking access. Not accessible eye wash and body wash station due to concrete ledge/curb for emergency use.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical  a) Building 3 Liquid Compounding Room; On or about August 30, 2023, employees were exposed to chemical hazards, in that the secondary drum of Sodium Metasilicate Pentahydrate, did not contain the chemical name and hazard categories of the chemical.  b) Building 3 Liquid Compounding Room; On or about August 30, 2023, employees were exposed to chemical hazards, in that the secondary bucket of Butylated Hydroxytoluene, did not contain the chemical name and hazard categories of the chemical.  c) Building 3 Liquid Compounding Room; On or about August 30, 2023, employees were exposed to chemical hazards, in that the secondary bag of Citric Acid, did not contain the chemical name and hazard categories of the chemical.
