29 CFR 1926.453(b)(2)(v): A body belt (harness) was worn and a lanyard was not attached to the boom or basket when working from an aerial lift: a) On or about 08/29/2023, during the installation of foam sheathing of the GLOW YMCA Healthy Living Campus, located at 209 East Main Street, Batavia, New York, the employer did not enforce the use of fall protection for employees working in the basket of an aerial boom lift, 10 feet above lower levels. Employees were allowed to work in an articulating boom without the proper use of Personal Fall Arrest Systems such as "tying off" to the boom basket. NO ABATEMENT CERTIFICATION REQUIRED
