29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) On or about May 18, 2023, at 1020 Vail View Drive, Vail, CO the employer did not provide training to employees regarding the safe operation of equipment in that a rock fell from the elevated bucket of an excavator that was in operation and struck an employee. This condition exposed employees to crushing and struck-by hazards. (b) On or about August 28, 2023, 157 Kings Row Street, Carbondale, CO the employer did not provide training to employees regarding the safe operation of equipment in that an excavator that was in operation struck a visible gas line that was above grade. This condition exposed employees to fire and struck-by hazards.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. (a) On or about May 18, 2023, the employer did not report a work-related in-patient hospitalization incident to OSHA within 24 hours. On May 18, 2023, at approximately 3:55 PM, at 1020 Vail View Drive, Vail, CO, an employee working in an excavation was struck-by a boulder which fell from an excavator bucket. The employee was transported to a hospital and admitted shortly thereafter. The employer reported the incident to OSHA on August 31, 2023 at approximately 1:10 PM MST.
