29 CFR 1926.451(g)(4)(xv): Cross bracing used in place of a mid-rail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a top rail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The endpoints at each upright were more than 48 inches (1.3 m) apart. a.) On or about August 29, 2023, employees were exposed to falls of over 10 feet from scaffolding where the cross point of the cross bracing was not between 38 and 48 inches for a top rail, measuring at approximately 53 inches from the work platform, with no mid-rail installed. b.) On or about August 31, 2023, employees were exposed to falls of over 10 feet from scaffolding where the cross bracing being used as a guard rail was serving as a mid-rail, with no top rail installed at the required height of between 38 and 48 inches from the work surface.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. On or about August 31, 2023, the competent person responsible for inspecting the scaffolding was not sufficiently proficient in scaffolding requirements such that there was no individual onsite who demonstrated adequate knowledge regarding the OSHA standards for both the fall protection and supported scaffolding criteria.
