29 CFR  1926.503(a)(2)(iii):  The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:  On or about September 5, 2023, and at times prior thereto, an employee worked on the leading edge and soffits at heights above six feet without being trained in the use of fall protection and recognition of fall hazards, exposing the employee to the hazard of falling.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about September 5, 2023, and at times prior thereto, on the south side of the multi-family residential building, an employee conducted roofing activities at heights greater than six feet without a fall protection system in place.  This condition exposed the employee to fall hazards.  Rangel J R Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1522873, citation number 1, item number 4, and was affirmed as a final order on July 16, 2021, with respect to a workplace located at 13301 Dessau Rd, Austin, Texas.

29 CFR  1926.150(c)(1)(viii): Portable fire extinguishers were not inspected periodically and maintained in accordance with maintenance and use of portable fire extinguishers, N.F.P.A. No. 10A-1970:  On or about September 5, 2023, and at times prior thereto, Victory portable fire extinguisher, serial number H18631654, in the JLG TX164681 lift, was not subjected to required monthly inspections in that the pressure gauge indicated "Recharge" and the safety pin was missing, exposing employees to fire/burn hazards.
