29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a)	Team CCI HVAC LLC dba Fry Heating & Cooling, on or about August 28, 2023 at the address of  2045 W. Sylvania Ave. Toledo OH 43613: The employer did not ensure employee(s) were protected from falls while performing HVAC unit servicing atop a commercial roof structure. Employee(s) performing these work activities without the benefit of an effective form of fall protection, such as personal fall arrests systems, covers or guard railing were exposed to falls of 15ft - 6" onto the ground below.

29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  a)	Team CCI HVAC LLC dba Fry Heating & Cooling, on or about August 28, 2023 at the address of  2045 W. Sylvania Ave. Toledo OH 43613: The employer did not ensure that employee(s) performing HVAC unit servicing atop a commercial structure were adequately protected from falling through multiple translucent corrugated fiberglass skylights measuring 3' X 8' on a low slope roof. Employee(s) performing these work activities without the benefit of an effective form of fall protection, such as personal fall arrests systems, covers or guard railing were exposed to falls of  between 12ft - 15ft - 6" onto the concrete floor below.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) Team CCI HVAC LLC dba Fry Heating & Cooling, on or about August 28, 2023 at the address of  2045 W. Sylvania Ave. Toledo OH 43613: The employer failed to report on employee hospitalization (admittance) following a workplace incident (fall through a roof). The employer or employer representative failed to contact the Toledo Area Office or the 24-hour OSHA number to notify the agency of the employee hospitalization within 24 hours of admittance. The employer did not report the incident until September 1, 2023 to the Toledo Area Office.
