OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to roll-over and tipping hazards while operating Toyota Electric standup forklifts inside of trailers while motor vehicles such as but not limited to tractor-trailers operated maneuvered in forward and in reverse gear: a. Freezer Area, on or about September 5, 2023, and at times prior, employees were exposed to tipping and roll-over hazards in that a worker assigned to unload doors on the loading dock was operating a Toyota Electric standup forklift inside of tractor-trailer when the tractor-trailer pulled away from the dock prematurely due to lack of communication.
