OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by wood building components in the event of structural collapse.  a. Mullet's Construction LLC located at 55 Rebel Drive, Crown City, OH 45623:  On or about September 6, 2023, adequate bracing was not provided for the trusses and walls of the newly constructed 100 foot long by 80 foot wide  storage/warehouse building while 80 foot long metal plate connected wood trusses were being installed atop 14 foot tall wooden framed walls. Employees were exposed to hazards of being struck by building components when walking and working beneath the previously set trusses and while performing truss setting operations prior to and during a truss collapse event.

Mullet's Construction LLC located at 55 Rebel Drive, Crown City OH 45623: On or about September 6, 2023 and at times prior to, the employer did not develop and maintain safety and health programs to ensure that hazards were identified and corrected onsite prior to employees performing framing work.

Mullet's Construction LLC located at 55 Rebel Drive, Crown City OH 45623: On or about September 6, 2023 and at times prior to, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to the framing work that the crew was engaged in, which included related but was not limited to falls and truss bracing.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a. Mullet's Construction LLC located at 55 Rebel Drive, Crown City, OH 45623:  On or about September 15, 2023 and at times prior,  framers setting trusses on an under construction storage/warehouse building did not utilize any form of fall protection/prevention while standing on the framed walls which exposed them to falls of 14 feet.
