29 CFR  1910.146(f): The entry permit that documented compliance with this section and authorized entry into a permit space did not identify the requirements in (f)(1)-(15) of this section:   (a) Wet Batch Plant Mixer (Plant 23); On or about August 7, 2023 and at times prior, entry was made into the mixing drum to chip out dried concrete. The entry permits did not include required information including, but not limited to, the name of the attendant, results of initial and periodic atmospheric testing, and verification of rescue service capabilities.

29 CFR  1910.146(k)(1): An employer who designates rescue and emergency services, pursuant to paragraph (d)(9) of this section shall evaluate the prospective rescuer's ability by the criteria set in this section, (k)(1)(i) - (k)(1)(v):   (a) Wet Batch Plant Mixer (Plant 23); On or about August 7, 2023 and at times prior, entry was made into the mixing drum to chip out dried concrete. The employer did not evaluate the rescue service capabilities per the requirements.

29 CFR  1910.146(d):Under the permit space program required by paragraph (c)(4) of this section the employer did not ensure that the requirements of (d)(1) through (d)(14) were met:  (a) Wet Batch Plant Mixer (Plant 23); On or about August 7, 2023 and at times prior, entry was made into the mixing drum to chip out dried concrete. The employer did not ensure applicable requirements per the permit space program were implemented, prior to and during entry.  Cemstone Ready Mix was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.146(d), which was contained in OSHA inspection number 1630390, citation number 1, item number 3b and was affirmed as final order on April 20, 2023, with respect to a workplace located at 1190 County Road G, New Richmond, WI 54017.
