29 CFR  1910.147(c)(1): General - Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  a) On or before September 8, 2023, the employer did not have an energy control program that included machine specific energy isolation procedures, training for employees, and periodic inspections of the procedures on an annual basis for equipment such as, but not limited to the Run-A-Gade Horizontal Band Saw.

29 CFR  1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:   (1) Preparation for shutdown. Before an authorized or affected employee turns off a machine or equipment, the authorized employee shall have knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy. (2) Machine or equipment isolation. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage. (3) Machine or equipment isolation. All energy isolating devices that are needed to control the energy to the machine or equipment shall be physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s). (4) Lockout or tagout device application. Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees. (5) Stored energy. Following the application of lockout or tagout devices to energy isolating devices, all potentially hazardous stored or residual energy shall be relieved, disconnected, restrained, and otherwise rendered safe. (6) Verification of isolation. Prior to starting work on machines or equipment that have been locked out or tagged out, the authorized employee shall verify that isolation and deenergization of the machine or equipment have been accomplished.  1) On or about September 8, 2023, the electrical disconnect was not shut off and locked out when changing or unjamming the blade on equipment such as, but not limited to the Run-A-Gade Horizontal Band Saw.

Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  a) On or before September 8, 2023, the employer did not ensure that employees were initially trained on the safe operation of the Toyota Forklift before allowing them to operate it.

29 CFR  1910.213(i)(1): Bandsaws and band resaws. All portions of the saw blade shall be enclosed or guarded, except for the working portion of the blade between the bottom of the guide rolls and the table. Bandsaw wheels shall be fully encased. The outside periphery of the enclosure shall be solid. The front and back of the band wheels shall be either enclosed by solid material or by wire mesh or perforated metal. Such mesh or perforated metal shall be not less than 0.037 inch (U.S. Gage No. 20), and the openings shall be not greater than three-eighths inch. Solid material used for this purpose shall be of an equivalent strength and firmness. The guard for the portion of the blade between the sliding guide and the upper-saw-wheel guard shall protect the saw blade at the front and outer side. This portion of the guard shall be self-adjusting to raise and lower with the guide. The upper-wheel guard shall be made to conform to the travel of the saw on the wheel.  a) On or before September 8, 2023, the employer did not ensure that unworking portion of the blade was enclosed or guarded exposing employees to a caught in hazard.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a) On or about August 25, 2023, the employer failed to report within 24 hours an employee's hospitalization due to an amputation that occurred at the Run-A-Gade band saw in the warehouse.
