29 CFR  1910.178(l)(4)(i): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  Jobsite: The employer failed to ensure that an employee who was operating a Genie Rough Terrain Forklift #GTH-844 with an attached scaffolding platform was given refresher training (within three years) to ensure that the operator possessed the required knowledge and skills to operate the forklift in a safe manner.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  Jobsite: The employer did not ensure that employees were protected from fall hazards by the use of fall protection systems while installing sheathing to the exterior wall from a scaffold platform attached to a Genie rough terrain forklift. The employees standing on the top rail of the scaffolding platform, working approximately 12 feet, 8 inches from ground level.
