29 CFR  1910.266(h)(1)(i): Trees were felled in a manner that created a hazard for an employee, such as but not limited to, striking a rope, cable, power line, or machine:   On September 4, 2023, a redwood tree was felled uphill on steep   terrain, which created conditions that resulted in the felled tree sliding down the hill towards employees. Employees were exposed to throwback, sliding of felled trees, and falling branches, which resulted in the death of one employee and exposed others to potential injuries or death from crushing or impacts.

29 CFR  1910.266(h)(2)(ii): Before each tree is felled, conditions such as, but not limited to, snow and ice accumulation, the wind, the lean of tree, dead limbs, and the location of other trees, were evaluated by the feller but precautions were not taken so a hazard was not created for an employee.  On September 4, 2023, precautions were not taken to avoid creating hazards for employees during manual felling of a redwood. Employees were exposed to contact with trees and tree branches, which led to the death of one employee and exposed others to potential serious injury or death from crushing or impact.

29 CFR  1910.266(i)(3): Training provided for each employee did not consist of content(s) listed in subparagraphs 29 CFR 1910.266(i)(3)(i), (iii), and (v).  At a minimum, training did not consist of the following elements: 29 CFR 1910.266(i)(3)(i): Safe performance of assigned work tasks; 29 CFR 1910.266(i)(3)(iii): Recognition of safety and health hazards associated with the employee's specific work tasks, including the use of measures and work practices to prevent or control those hazards; and 29 CFR 1910.266(i)(3)(v): The requirements of this standard.   Employees were exposed to hazardous workplace conditions including contact with falling trees and branches, which can cause crushing or struck-by injuries.

29 CFR  1910.266(i)(10)(i): The employer did not verify compliance with paragraph (i) of this section by preparing a written certification record.  The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  If the employer relies on training conducted prior to the employee's hiring or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate.  On September 4, 2023 and at times prior, the employer did not verify compliance with the training requirements of this section by preparing and maintaining a written certification record.
