OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the saw blade furnished by the employer for use with the equipment was not designed/used as intended: On or about September 7, 2023, and at least a week prior, the DeWalt 14-inch chop saw (model no. D28715) located on the east wall of Building 117-17 next to the entry door, was not furnished with a saw blade designated for use with this type of equipment. On September 05, 2023, while in the process of operating the DeWalt chop saw (model no. D28715) to cut cardboard tubes, an employee was injured when inadvertent contact was made with the rotating blade.

29 CFR 1910.213(r)(4): Suitable guard(s) were not provided to reduce to a minimum the hazard due to the point of operation of the DeWalt Heavy Duty 14" Chop Saw: Bay door of the east wall in Building 117-17: On or about September 7, 2023, and at a week prior, the adjustable guard attached to the DeWalt 14" Chop Saw (with a rotational speed of 4300 rpms) did not adequately prevent contact with the rotating part. After release of the trigger mechanism, the saw blade would continue spinning exposing approximately 10 inches of the unguarded blade. Employees who used the saw when cutting cardboard tubes were not protected from hazards created by the rotating blade.
