1910.120(q)(1)  Emergency response plan. An emergency response plan shall be developed and implemented to handle anticipated emergencies prior to the commencement of emergency response operations. The plan shall be in writing and available for inspection and copying by employees, their representatives and OSHA personnel. Employers who will evacuate their employees from the danger area when an emergency occurs, and who do not permit any of their employees to assist in handling the emergency, are exempt from the requirements of this paragraph if they provide an emergency action plan in accordance with 29 CFR 1910.38.  Alleged violation description is:   (1.)  On or about August 20, 2023, the emergency response plan was not implemented when employees responded to an isocyanate spill without personal protective equipment to protect from dermal absorption such as gloves and a chemical impervious suit.   (2.)  On or about August 20, 2023, the emergency response plan was not developed to include decontamination procedures when employees responded to an isocyanate spill.

29 CFR 1910.120(q)(3)(iv): Employees engaged in emergency response and exposed to hazardous substances presenting an inhalation hazard or potential inhalation hazard, did not wear positive-pressure self-contained breathing apparatus until such time that the individual in charge of the incident command system determined through the use of air monitoring that a decreased level of respiratory protection would not result in hazardous exposures to employees:  On or about August 30, 2023, two employees responded to an isocyanate spill without wearing a positive-pressure self-contained breathing apparatus. The employer had not identified employee exposures to isocyanate, nor made a reasonable estimate of employee exposures to isocyanate levels when employees were responding to an unexpected isocyanate spill.

29 CFR  1910.120(q)(6)(ii): First responders at the operational level did not receive at least eight hours of training or did not have sufficient experience to objectively demonstrate competency in the areas required by 29 CFR 1910.120(q)(6)(ii)(A) through (q)(6)(ii)(F) and/or the employer did not so certify:  On or about August 30, 2023, two employees did not have operational level training or experience to clean-up and or contain an isocyanate spill in Building 49 Foam Room.

29 CFR  1910.120(q)(8)(i):Employees who were trained in accordance with 29 CFR 1910.120(q)(6) did not receive annual refresher training of sufficient content and duration to maintain their competencies or did not demonstrate competency in those areas at least yearly:  On or about August 30, 2023, there was an isocyanate spill and the responding employees that were 24 hour certified per 1910.120(q)(6) did not have annual  refresher training.
