OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating forklifts without the use of a restraint device: a. 425 Summit Avenue, Jersey City, NJ The employer failed to ensure employees operating powered industrial trucks utilized restraint devices when operating the equipment. An employee operated a Moffett, M8 NX forklift to move pallets of Gypsum board without wearing a seatbelt. While placing the materials on the loading dock, the employee fully extended the forks loaded with three pallets horizontally, causing the center of gravity of the forklift to shift forward. The machine became unstable, rocked violently where the employee struck the steering wheel and windshield, and ejected the employee from the cab causing serious bodily injury. Violation occurred on or about September 11, 2023
