29 CFR 1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: a) 2351 Richmond Terrace Staten Island , NY 10302, On or about 9/07/2023 and thereafter, the employer had not assessed employee exposure(s) to respirable crystalline silica dust for employee(s) in and around the concrete plant who perform duties that potentially exposed them to dust from dry pre-mix concrete and stone dust. Employee(s)' site activities include cement truck drop-loading of dry pre-mix and other site support activities such as stone transport via front-loader as well as truck wash-down and general clean-up and wetting of the yard. Representative personal exposure monitoring conducted by OSHA on 12/08/2023 and measured airborne respirable crystalline silica exposure levels at 0 micrograms per cubic meter for 1) the lead concrete plant attendant (truck-loading), 2) equipment operator (stone transport via front-loader), 3) yard laborer and 4) the yard supervisor.
