OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards.    On or about July 21, 2023, three employees were riding in the bed of a pick-up truck not designed for human occupancy while in transport and exposed to struck-by hazards.

29 CFR  1904.39(a)(1):The employer did not report within 8-hours the death of an employee resulting from a work-related incident   On July 28, 2023, and employee suffered a workplace injury resulting in a fatality.  The fatality was not reported within 8 hours to the local Area Offices of the Occupational Safety and Health Administration.
