Before an employee entered the butadiene decant tank in the latex department, the employer did not maintain the equipment properly and did not ensure that employees used the equipment properly, specifically the Draeger XAM8000, Serial Number ARSA0162  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.146(d)(5)(i): 29 CFR 1910.146(d)(5)(i):  Under the permit required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing conditions in the permit space to determine if acceptable entry conditions existed before entry was authorized to begin, and, if entry is authorized, entry conditions shall be continuously monitored in the areas where authorized entrants are working;  Latex Department: On or about September 5, 2023, before employees from Sabic Innovative Plastics U.S. LLC, entered the butadiene decant tank in the latex department, the employer did not ensure that (a) the Draeger XAM8000 meter, Serial Number ARSA0162 was calibrated and bump tested according to the manufacturer?s guidelines prior to use; or (b) the entrants tested the atmosphere with said meter for flammable gases and vapors around the removable baffle to ensure that safe entry conditions existed before entry was authorized to begin.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

The employer did not ensure that the Permit Required Confined Space training provided to employees who were required to enter the butadiene polymer horizontal tank included difference of entry into a horizontal tank vs. a vertical tank to establish employee proficiency with respect to locations inside the tank where employees should perform gas meter tests to determine if acceptable and safe entry conditions exist before entry is authorized to begin.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

The employees used a High Torque Impact Wrench in order to remove the baffle.  The employer did not ensure that all the tools and equipment available for use by employees was safe for the location  in that it was of a type and design that the employer demonstrated would provide protection from the hazards arising from the combustibility and flammability of vapors, liquids, gases, dusts, or fibers involved, such as Butadiene vapors.  Abatement documentations is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
