29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)R&L Construction, LLC at 5400 West University Trail, Sioux Falls, SD 57107: On or about and at times prior to September 13, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards as a result of conducting commercial framing activities without the use of a fall protection system and a lack of Personal Protective Equipment (PPE). This condition exposed employees to fall and struck-by hazards.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: (a)R&L Construction, LLC at 5400 West University Trail, Sioux Falls, SD 57107: On or about and at times prior to September 13, 2023, the exposing employer did not ensure that each employee that was installing roof sheathing on a commercial property with the use of a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection. This condition exposed employees to struck-by hazards. (b)R&L Construction, LLC at 5400 West University Trail, Sioux Falls, SD 57107: On or about and at times prior to September 13, 2023, the exposing employer did not ensure that each employee that was preparing roof trusses for install on a commercial property with the use of a battery powered circular saw was protected from flying particles by the use of appropriate eye protection. This condition exposed employees to struck-by hazards.

29 CFR 1926.501(b)(1): Employees on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a)R&L Construction, LLC at 5400 West University Trail, Sioux Falls, SD 57107: On or about and at times prior to September 13, 2023, the exposing employer did not ensure that employees were protected from falls while conducting commercial framing and sheathing activities on a commercial building. This condition exposed the employees to fall hazards greater than six feet. R and L Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1632964, citation number 1, item number 1, and was affirmed as a final order on April 18, 2023, with respect to a workplace located at 2105 North Carla Avenue, Tea, SD 57064.
