Except as provided elsewhere in this section or by other subparts of 29 CFR part 1910, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by: 29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): On or about September 10, 2023, inside the Gen 3 structure on the second level, employees were performing activities such as but not limited to repairing and reorienting picking robots from catwalks with unprotected holes at heights 4-feet or greater above the lower level.

29 CFR 1910.145(f)(3): Tags were not used as a means to prevent accidental injury or illness to employees who were exposed to hazardous or potentially hazardous conditions, equipment or operations which were out of the ordinary, unexpected or not readily apparent: On or about September 10, 2023, on catwalks inside the Gen 3 structure, employees were performing activities such as, but not limited to repairing and reorienting picking robots. Tags were not used to warn employees that the open/close status of the catwalk may not have been properly indicated by the user interface.
