29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, or uprights did not bear on base plates and mud sills or other adequate firm foundation.  a. On or about September 13, 2023, employees were exposed to fall hazards due to performing work from a scaffold approximately 18 feet in height that was tagged out for being under construction. Employees were performing masonry work using the scaffold to access the inner platform and store materials such as cinderblock and masonry materials. Not all supporting legs of the scaffold were rested on base plates, mud sills, or adequate firm foundation, some legs were rested on disturbed, loose, soil.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a. On or about September 13, 2023, employees were exposed to fall hazards due to performing work from a scaffold approximately 18 feet in height that was tagged out for being under construction. Employees were performing masonry work using the scaffold to access the inner platform and store materials such as cinderblock and masonry materials. There was no means of access to the upper level either in the form of stairs or a ladder; employees were using cross braces to scale the scaffolding.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a. On or about September 13, 2023, employees were exposed to fall hazards due to performing work from a scaffold approximately 18 feet in height that was tagged out for being under construction. Employees were performing masonry work from a scaffold that was red tagged for being under construction, using the scaffold to access the inner platform and store materials such as cinderblock and masonry materials.

29 CFR  1926.451(h)(2):Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section  a. On or about September 13, 2023, employees were exposed to struck by hazards due to performing work from and around a scaffold 17 ft 10 inch high that was tagged out for being under construction. Employees were performing masonry work on a stairwell using the scaffold to access the inner platform and store masonry materials, such as a stack of cinderblock and metal wheelbarrow-like bin. The doorway to enter into the stairwell was below the scaffold where the large metal bin sat, exposing employees to possible falling cinderblock or other construction materials from the top platform of the scaffold.
