OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not establish boundaries, or other means, to keep ground workers clear of the Skid Steer's movement, exposing employees to struck-by and crushing hazards. (a) Worksite: On or about 9/14/2023 the employer did not ensure that ground worker employees were protected from struck-by and crushing hazards while performing site excavation and clean-up activities within the operating area of the CASE 450 Skid Steer.
