29 CFR 1926.451(c)(1)(ii): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by installing guys, ties, and braces according to the manufacturer's recommendation or at the closest horizontal member to the 4:1 height and be repeated vertically at locations of horizontal members every 20 feet (6.1 m) or less thereafter for scaffolds 3 feet (0.91 m) wide or less: a) On or about September 13, 2023, at the new Home 2 Suites hotel, the employer's three-foot-wide scaffold's restraining ties were installed at 20 feet and 40 feet instead of at 12 feet, 24 feet and 36 feet.

29 CFR 1926.451(c)(3): Supported scaffold poles, legs, post, frames, and/or uprights were not plumb and braced to prevent swaying and displacement in the following instances: a) On or about September 13, 2023, at the new Home 2 Suites hotel, the 29-frames of the first (ground) level of the scaffold system were erected without bracing on the interior (wall side) of the scaffold frames to ensure that the frames were plumb and evenly spaced to prevent swaying or displacement of the upper six levels.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration: On or about September 13, 2023, at the new Home 2 Suites hotel the scaffolding was erected with the following deficiencies: a) The 29-frames of the first (ground) level of the scaffold system were erected without bracing on the interior (wall side) of the scaffold frames to ensure that the frames were plumb and evenly spaced to prevent swaying or displacement of the upper six levels. b) The east ends of the 2nd, 3rd, 4th, 5th, 6th and 7th platforms were not guarded to prevent employees from falling. c) The three-foot-wide scaffold system was not secured to the building at a 4:1 height ratio (12-foot vertical intervals).

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms: a) On or about September 13, 2023, at the new Home 2 Suites hotel, the east ends of the second, third, fourth, fifth, sixth and seventh levels of the platform were not guarded. Employees were observed leaning out of the open ends to apply waterproofing to the exterior of the structure.
