29 CFR  1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval: Note:  If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly:   Corner of Davis Ranch Parkway and Skanks Mill, San Antonio, TX, 78254: On or about September 13, 2023, and times prior thereto, employees were  exposed to struck-by hazards while operating a John Deer 410J Backhoe Excavator with modifications made to the rear extendable Pivot Arm without the manufacturer's written approval.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support:    corner of Davis Ranch Parkway and Skanks Mill, San Antonio, TX, 78254: On or about September 13, 2023, and times prior thereto, employees were exposed to fall hazards while entering and exiting an excavation with a ladder not extended 3 feet above the landing surface.

Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided:    Corner of Davis Ranch Parkway and Skanks Mill, San Antonio, TX, 78254: On or about September 13, 2023, and times prior thereto, employees were exposed to a struck-by hazard while inside an excavation with spoil piles located less than 2 feet from the edge of the excavation walls.  The CTR Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.651(j)(2) which was contained in OSHA inspection number 1602125, citation number 1, item number 1, and was affirmed as a final order on 09-20-2022, with respect to a workplace located at 10500 Mitra Way & University Way, San Antonio, TX 78201.

The CTR Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.651(k)(1), which was contained in OSHA inspection number 1602125, citation number 1, item number 2, and was affirmed as a final order on 09-20-2022, with respect to a workplace located at 10500 Mitra Way & University Way, San Antonio, TX 78201.

The CTR Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.652(a)(1) which was contained in OSHA inspection number 1602125, citation number 1, item number 3, and was affirmed as a final order on 09-20-2022, with respect to a workplace located at 10500 Mitra Way & University Way, San Antonio, TX 78201.
