29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. a) F&J Roofing, LLC at the Dacotah Bank Center located at 824 32nd Avenue, Brookings, SD 57006: On or about and at times prior to September 15, 2023, the exposing employer did not ensure employees installing a membrane roof over metal roof installation used appropriate fall protection systems when working at heights greater than six feet above a lower level. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: a)F&J Roofing, LLC at the Dacotah Bank Center located at 824 32nd Avenue, Brookings, SD 57006: On or about and at times prior to September 15, 2023, the exposing employer did not ensure employees using a Skyjack J82T Aerial Lift to access and egress the roof were protected from fall hazards while within the basket of the aerial lift by a fall protection system. This condition exposed employees to fall hazards. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.
