29 CFR  1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  On or about September 07, 2023, an employee was exposed to machine hazards associated with moving mechanical parts and struck by hazards during service and maintenance of the CNC housing of the ITALMAC CNC Machine. The employer failed to develop, document, and utilize machine specific procedures for the ITALMAC CNC Machine to protect employees from machine servicing hazards. As a result, hazardous energies including pneumatic, and electrical were not isolated, exposing the employee(s) to struck by hazards associated with the reciprocating movements of the CNC housing unit.

29 CFR  1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  On or about September 07, 2023, an employee was exposed to machine hazards associated with moving mechanical parts and struck by hazards during service and maintenance of the CNC housing of the ITALMAC CNC Machine. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6), were not implemented to protect employees from machine servicing hazards.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about September 07, 2023, the employer did not ensure that the ITALMAC CNC Machine was effectively guarded to prevent employees from entering the hazardous area in that the interlocked gate was able to be closed behind an employee making entry. Employee(s) working inside the ITALMAC CNC Machine area were exposed to struck by hazards associated with the reciprocating movements of the spindle housing.

29 CFR  1910.147(c)(7)(i)(A):Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation:  On or about September 07, 2023, an employee was exposed to machine hazards associated with moving mechanical parts and struck by hazards during service and maintenance of the CNC housing of the ITALMAC CNC Machine. The employer failed to provide training to ensure authorized employees understood the purpose and function of the energy control program and employees had acquired the knowledge and skills required for the safe application, usage, and removal of energy controls.
