29 CFR § 1910.9(a): Personal protective equipment. Standards in this part requiring the employer to provide personal protective equipment (PPE), including respirators and other types of PPE, because of hazards to employees impose a separate compliance duty with respect to each employee covered by the requirement. The employer must provide PPE to each employee required to use the PPE, and each failure to provide PPE to an employee may be considered a separate violation.  On or about September 13, 2023, employees were exposed to the hazards of high heat from direct sunlight during the performance of their duties including planting sugarcane. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 24? to 31? (76? to 87?) while working outdoors performing light to moderate manual labor and wearing long-sleeve shirt, jeans, boots, handkerchief, and hat. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.
