29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section.  (a) On or about Sept 20, 2023, at 8419 Corliss Ave. Sturtevant, WI 53177, the employer did not ensure that an employee installing Tyvek from a platform supported by a Genie GTH-1056 telescopic forklift at an approximate height of 36 feet was protected from falls to the lower level with fall protection.

(a) On or about Sept 20, 2023, at 8419 Corliss Ave. Sturtevant, WI 53177, the employer did not ensure that all employees that work on elevated platforms were trained to recognize hazards associated with working on scaffolding thus exposing employees to electrical hazards, fall hazards and falling object hazards.

On or about Sept 20, 2023, at 8419 Corliss Ave. Sturtevant, WI 53177, frequent and regular job site inspections were not conducted to identify and correct safety hazards, including but not limited to fall hazards and struck by hazards.  Daniel Lopez Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(2), which was contained in OSHA inspection number 1646814, citation number 1, item number 1 and was affirmed as a final order on April 24, 2023, with respect to a workplace located at 661 Harding Rd. Morton, IL 61550.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a)  On or about Sept 20, 2023, at 8419 Corliss Ave. Sturtevant, WI 53177, an employee installing Tyvek on a new build residential apartment was not protected from falling to the lower level. This exposed the employee to a fall hazard of approximately 11 feet.  Daniel Lopez Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1646814, citation number 1, item number 2 and was affirmed as a final order on April 24, 2023, with respect to a workplace located at 661 Harding Rd. Morton, IL 61550.
