OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rollover hazards while using a Polaris ATV. Location: Worksite, open field area @ 202 Pine Hill Road, Westport, MA. 02790 On or about 9/21/23, employees were exposed to caught-in-or-between and struck-by hazards where a Polaris ATV rolled over while transporting employees and tools to the new solar panel working area, injuring employees. The employer did not ensure that the ATV was operated in a safe manner, nor ensure that employees used seat belts or the required personal protective equipment while riding in the ATV.
