29 CFR 1910.27(a): The employer did not ensure that scaffolds used in general industry meet the requirements in 29 CFR part 1926, subpart L (Scaffolds). a. Site Parking Lot - On or about September 20, 2023, an employee conducting tree branch cutting operations on a Daewoo Mega 400-V Wheel Loader with fork attachment, Serial # 1297 with an 8.8'L x 3.6'W and 1" thick steel plate resting on top of the forks, was raised approximately ten (10) to fifteen (15) feet above ground with no adequate fall protection, thereby exposing the employee to fall hazards. The scaffold (i.e., front loader with a steel metal plate resting on the forks) did not meet the requirements of 29 CFR part 1926, subpart L.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a. Site Parking Lot - On or about September 20, 2023, an employee conducting tree branch cutting operations on a Daewoo Mega 400-V Wheel Loader with fork attachment, Serial # 1297 with an 8.8'L x 3.6'W and 1" thick steel plate resting on top of the forks, was raised approximately ten (10) to fifteen (15) feet above ground. The employee was not provided training on how to minimize fall hazards, thereby exposing the employee to hazards associated with falls.
