29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On September 21, 2023, at the above addressed jobsite, employees were exposed to a struck-by hazard from falling tools, material and debris when working below employees.  The employees were not wearing hard hats.  No abatement certification or documentation is required for this item.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation.  a) On September 21, 2023, at the above addressed jobsite, employees were exposed to eye injury while operating pneumatic nail guns and prying wood without eye protection.     No abatement certification or documentation is required for this item.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On September 21, 2023, at the above addressed jobsite, employees performing installation of a roof on a residential home, approximately nine (9) and 18 feet above the levels below, were not secured to a personal fall arrest system or other means of fall protection, thereby exposing the employees to fall hazards.    No abatement certification or documentation is required for this item.  Elias Aucacama Mendoza dba ESN Construction, Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1506534, citation number 1, item number 1, and was affirmed as a final order on May 25, 2021, with respect to a workplace located at 339 Juniper Circle in Streamwood, Illinois.
