OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by wood building components in the event of structural collapse: (a) On or about September 20, 2023, employees were exposed to the hazards of being struck-by building components when walking and working beneath the previously set trusses and while performing truss setting operations prior to and during a truss collapse event. The employer did not ensure that the adequate bracing was provided for the metal plate connected wood trusses and walls of the newly constructed 106 foot long by 50 foot wide garage building, while 50 foot long metal plate connected wood trusses were being installed atop 10 foot 5 inches tall wooden framed walls. (b)On or about September 20, 2023, employees were exposed to struck-by hazards while rigging and lifting metal plate connected wood trusses. The employer did not ensure that employees were using a spreader bar 1/2 to 2/3 Truss length to lift and place a single 50 foot long metal plate connected wood truss to prevent lateral bending of the truss during handling and installation operations.
