29 CFR 1910.178(l)(3)(ii)(A):):  Powered industrial truck operators did not receive sufficient training in surface conditions where the vehicle would be operated that could affect safe operation:   On or about September 12, 2023, at 3420 Plano Parkway, The Colony, Texas, employees at the jobsite operating equipment were not provided sufficient hazard recognition and avoidance training of unsafe worksite conditions in the following instances (a-e):  a) large open holes for the spa tubs were present and exposed employees and equipment operators of the JCB 506-36, 6000 pound rough terrain forklift to fall hazards, b) uneven ground conditions with slopes with a 25-degree and 39-degree incline exposed equipment operators to tip-over hazards, c) equipment operators of the JCB 506-36, 6000 pound rough terrain forklift lifting and carrying uneven and unsecured loads to tip-over and struck-by hazards, d) equipment operators lifting loads at heights of up to 20 feet above the cab and moving the load on uneven surfaces exposed employees to tip-over and struck-by hazards,

On or about September 12, 2023, at 3420 Plano Parkway, The Colony, Texas, employees at the jobsite operating equipment were not provided sufficient hazard recognition and avoidance training when stacking and unstacking loads on rough terrain or uneven surfaces in the following instances (a-e):  a) large open holes for the spa tubs were present and exposed employees and equipment operators of the JCB 506-36, 6000-pound rough terrain forklift to fall hazards, b) uneven ground conditions with slopes with a 25-degree and 39-degree incline exposed equipment operators to tip-over hazards, c) equipment operators of the JCB 506-36, 6000-pound rough terrain forklift lifting and carrying uneven and unsecured loads to tip-over and struck-by hazards, d) equipment operators lifting loads at heights of up to 20 feet above the cab and moving the load on uneven surfaces exposed employees to tip-over and struck-by hazards,

29 CFR 1910.178(l)(3)(ii)(G): Operator training did not include sufficient workplace related topics such as ramps and other sloped surfaces that could affect the vehicle?s stability:   On or about September 12, 2023, at 3420 Plano Parkway, The Colony, Texas, employees at the jobsite operating equipment over sloped surfaces were not provided sufficient hazard recognition and avoidance training potentially exposing employees to struck-by and tip-over hazards.

29 CFR 1926.602(a)(3)(i):  Construction equipment or vehicles were moved or caused to be moved upon an access roadway or grade without sufficiently ensuring the access roadway or grade was constructed and maintained to safely accommodate the movement of equipment and vehicles.   On or about September 12, 2023, an employee operated a JCB 506-36 Rough Terrain Forklift on an unstable grade with large holes and various steep slopes meant for swimming pools and spa construction.  The condition exposed employees and the equipment operators to potential struck-by and roll-over hazards.

29 CFR 1926.20(b)(2): The employer did not sufficiently initiate and effectively maintain programs which provided for frequent and regular inspection of the jobsite, materials and equipment to be made by a competent person(s).   On or about September 12, 2023, jobsite hazards existed, and the employer did not effectively conduct a Job Hazard Assessment or sufficiently conduct jobsite inspections, potentially exposing employees to struck-by and roll-over hazards.
