29 CFR 1910.178(l)(2)(i)(B): Powered Industrial Truck operator trainees performed training operations where such operation endangered the trainee or other employees: (a)Tractor Supply Company Store #2164 located at 509 West Cherry Street, Vermillion, SD 57069: On or about and at times prior to September 20, 2023, the employer did not ensure forklift training instructors were protected from struck-by hazards in that trainees operated forklifts in close proximity to instructors during the practical training portion of the company's forklift training program. This condition exposed employees to struck-by and crushing hazards.

29 CFR 1910.178(a)(4):Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a)Tractor Supply Company Store #2164 located at 509 West Cherry Street, Vermillion, SD 57069: On or about and at times prior to September 20, 2023, the employer did not ensure employees were protected from struck-by hazards related to forklift operations in that the Toyota Model: 8FGU25, Serial Number: 75836 did not have a data plate to reflect the load capacity for use of the spreader bar to lift cattle panels. This condition exposed employees to struck-by hazards.
