29 CFR 1926.651(c)(2): A safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth: On or about September 26, 2023, in an excavation measuring approximately 12 feet deep, employees were installing and connecting an 8-inch diameter water line to a 16-inch water main. An employee was observed exiting the southeast end of the manhole box into an unprotected area of the excavation to use a ladder to climb out of the excavation. Diamond Construction was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1626165, citation number 1, item number 1 and was affirmed as a final order on April 5, 2023, with respect to a workplace located at 1870 John Hardin Drive, Jacksonville, Arkansas.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about September 26, 2023, in the excavation where employees were installing and connecting an 8-inch diameter water line to a 16-inch water main in the following instances: a) An employee exited the southeast end of the manhole box to climb a ladder staged outside of the box in an unprotected portion of the excavation b) An employee worked outside of the northwest end of the box to clear loose soil from the bottom of the excavation. Diamond Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1626165, citation number 1, item number 2 and was affirmed as a final order on April 5, 2023, with respect to a workplace located at 1870 John Hardin Drive, Jacksonville, Arkansas.
