29 CFR 1910.252(b)(2)(iii):Protection from arc welding rays. Where the work permits, the welder should be enclosed in an individual booth painted with a finish of low reflectivity such as zinc oxide (an important factor for absorbing ultraviolet radiations) and lamp black, or shall be enclosed with noncombustible screens similarly painted. Booths and screens shall permit circulation of air at floor level. Workers or other persons adjacent to the welding areas shall be protected from the rays by noncombustible or flameproof screens or shields or shall be required to wear appropriate goggles. a. On or before October 2, 2023, the employer did not ensure that welding area was enclosed by either a booth or screens to protect employees working nearby from arc welding rays.

29 CFR 1910.1053(d)(1):Exposure assessment-(1) General. The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section. a. On or before October 2, 2023, the employer did not conduct an exposure assessment to determine the exposure level of employees exposed to crystalline silica in the workplace.
