29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift: a) Job site, 5035 Clairton Boulevard, Pittsburgh, PA: On or about October 2, 2023, during painting activities, the employer did not ensure that employees used appropriate fall protection systems/devices while working in the basket of a Genie aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.20(b)(2): The employer did not ensure that frequent and regular inspections of the job sites, materials, and equipment were made by a competent person: a) Job site, 5035 Clairton Boulevard, Pittsburgh, PA: On or about October 2, 2023, during painting activities, the employer did not ensure that the worksite was inspected for hazards and those found were corrected prior the start of work or as the work was on going. Deficiencies noted during the inspection included, but were not limited to, working in an aerial lift without fall protection, painting near potentially live electrical equipment, straddling the top of a ladder and standing on a ladder while facing away it to do work.
