29 CFR 1928.57(a)(11): Where a moving machinery part presented a hazard during servicing or maintenance, the engine was not stopped, the power source was not disconnected, and all machine movement was not stopped before servicing or maintenance was performed, except where the employer could establish the following in 1928.57(a)(11)(i-iii): (a) On or before 9/22/2023, the employer did not ensure that all employees were clear of the potato conveyor when it was restarted. An employee tried to clean the roller as it was moving and was drawn in between the belt and roller. The employee was injured and hospitalized. This condition exposed employees to caught-in hazards.

29 CFR 1928.57(a)(6): At the time of initial assignment and at least annually thereafter, the employer did not instruct every employee in the safe operation and servicing of all covered equipment with which he was or would be involved: (a) On or before 10/2/23, the employer did not ensure that all employees working on equipment covered by this section were trained at least annually in the operation and servicing of the equipment. An employee was operating a potato conveyor system that was new to the company. This condition exposed employees to hazardous energy.
