29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. The employer did not provide employees with effective information and training on the chemical hazards associated with propane operated and electric operated forklifts. Employees operating daily, are exposed to injuries such as corrosive skin burns, severe eye damage, potential fire and explosion from off-gassing while charging batteries, or propane leaks leading to carbon monoxide poisoning which could result in permanent disability or death. The following instances were identified: (a) On or about October 3, 2023, the employer did not train employees on the chemical hazards associated with the lead acid forklift batteries on the electric stand-up fork trucks and the electric order picker/cherry pickers. (b) On or about October 3, 2023, the employer did not train employees on the chemical hazards associated with the task of watering the lead acid batteries. (c) On or about October 3, 2023, the employer did not train employees on the chemical hazards associated with the propane operation or tank installation/removal for the propane powered forklifts. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(l)(3): Training program content. Powered industrial truck operators shall receive initial training in the topics listed within 1910.178(l)(3)(i) - (iii). On or about October 3, 2023, the employer did not ensure that operators were trained on truck-related topics for each type of powered industrial vehicle to be operated. The employer utilizes electric stand-up forklifts, propane sit-down forklifts, electric reach trucks, and electric power jacks ranging as listed: Raymond Model 425C35TT (1); Raymond Model 750R45TT (2); Raymond Model 550OPC30TT (5); Raymond Model 8410 (2); Toyota Model 8FGCU25 (1); Toyota Model 8BNCU20(1); Toyota Model 8FGCU25(1); and Genie Model GS3246(1). Employees were only given general industrial powered truck training, and nothing specific to the type of truck they were operating. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
