29 CFR 1926.20(b)(2): General safety and health provisions. Accident prevention responsibilities. It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazards associated with working at heights greater than 6 feet without using fall protection equipment, using a non-approved work platform supported by a rough terrain forklift, using a work platform prior to securing it to the supporting forklift, and using a board less than 18 inches wide as a walkway over a ditch.

29 CFR 1926.451(a)(6): Capacity. Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, an employee was exposed to a potential fall hazard while using a pallet as a work platform supported by a Caterpillar TL1055D Telehandler at heights greater than 10 feet. The employer was not following the manufacturer's recommendation for using an approved personnel work platform.

Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide. On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, employees were exposed to a fall hazard while using stacked boards as a walkway over the top of a ditch to access/egress a work area without the walkway at least 18 inches wide. The walkway surface was approximately 9.5 inches wide.

Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.
