29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about 3 October 2023, employees of Second To None Exteriors, LLC were installing roofing materials on the roof of a residential building located at 24 Birdseye Court in Wentzville, MO. Three employees were not wearing eye protection while using pneumatic nail guns.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above the lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  On or about 3 October 2023, employees of Second To None Exteriors, LLC were exposed to fall hazards while working on the roof of a residential building located at lot 24 Birdseye Court in Wentzville, Missouri. The employees were installing roofing materials without fall protection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.  On or about 3 October 2023, employees of Second To None Exteriors, LLC were exposed to fall hazards at 24 Birdseye Court in Wentzville, Missouri. The employees were installing roofing materials on the second-story of a residential building. The employees accessed the roof using a ladder that was not extended 3 feet beyond the upper landing surface.
