29 CFR  1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On or about October 3, 2023, the employer did not ensure that frequent and regular inspections were being conducted for the jobsite at 139 Ritchie Avenue, Cincinnati, OH 45215. As a result, employees were exposed to a fall hazard of 8'11" from a lack of fall protections and improper ladder usage. Additionally, employees were exposed to electrical shock hazards from working in close proximity to live electrical power lines.

29 CFR  1926.416(a)(1): Protection of employees. No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means.   a) On or about October 3, 2023, the employer did not ensure that employees working within three feet proximity of a live electrical wire were protected against electric shock.

The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated: (12)Ladders shall have nonconductive siderails if they are used where the employee or the ladder could contact exposed energized electrical equipment, except as provided in 1926.951(c)(1) of this part.  a) On or about October 3, 2023, the employer did not ensure that employees using a ladder to access the roof near energized electrical equipment were using a ladder with nonconductive siderails.

29 CFR  1926.1053(b): Use. The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated: (1) When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) On or about October 3, 2023, the employer failed to ensure that the Little Giant ladder that was being utilized by employees performing re-roofing activities to access the roof was extended at least 3 feet above the upper landing. As a result, an employee was exposed to a fall hazard of 8'11".  Walter St. Clair Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1594147, citation number 1, item number 2 and was affirmed as a final order on (date), with respect to a workplace located at 3742 Marburg Avenue, Cincinnati, OH 45209.

29 CFR  1926.503(b)(1): Certification of training. The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  a) On or about October 3, 2023, the employer did not ensure that written training records for fall protection were being maintained in that the employer did not have training records for employees working at 139 Ritchie Avenue, Cincinnati, OH 45215.
