29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: (a) On or about October 4, 2023, an employee was preforming grinding work on bricks of an existing commercial building, without wearing respiratory protection, exposing the employee to respirable silica dust.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) On or about October 4, 2023, at the job site located at 8989 North Port Washington Road, Bayside WI, employees working on a tubular scaffolding were not utilizing fall protection which exposed the employees to an 18 foot 5 inch fall hazard. (b) On or about October 4, 2023, at the jobsite located at 8989 North Port Washington Road, Bayside WI, employees were conducting grinding work from a scaffold with no top rails in place, and the middle planks were not secured in place where the employees were working. This exposed employees to a fall hazard of seventeen (17) feet or greater to the ground below.
