29 CFR 1910.29(b)(2):29 CFR 1910.29(b)(2): The employer did not ensure that guardrail systems met the requirement that midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members that are installed between the walking-working surface and the top edge of the guardrail system as follows when there is not a wall or parapet that is at least 21 inches (53 cm) high. (a) On or about October 4, 2023, the employer did not ensure that the guardrail system on the Raymond ACR 5200 order picker had midrails installed at the access and egress point to the order picker. This exposed employees to a fall hazard between the order picker personnel lift platform and the access point to the order picker while working from an elevated position. (b) On or about October 4, 2023, the employer did not ensure that the guardrail system on the Raymond ACR 5500 order picker had midrails installed at the access and egress point to the order picker. This exposed employees to a fall hazard between the order picker personnel lift platform and the access point to the order picker while working from an elevated position.

The employer manufactured a personnel lifting platform to be attached to the order picker, and did not obtain written approval from the manufacturer of the order picker.
