29 CFR 1910.179(j)(2):The following items were not being inspected for defects at intervals as defined in paragraph (j)(1)(ii) of this section or as specifically indicated, including observation during operation for any defects which might appear between regular inspections: a) Warehouse floor, On or about October 4, 2023, and at times prior, the employer exposed employees to struck-by and crushing hazards while moving slabs of stones, in that an overhead crane (Gorbel 2000lbs. capacity manual crane) were not being inspected frequently. b) Polishing room, On or about October 4, 2023, and at times prior, the employer exposed employees to struck-by and crushing hazards while moving slabs of stones, in that an overhead crane (Gorbel 2000lbs. capacity manual crane) were not being inspected frequently. c) Production floor, On or about October 4, 2023, and at times prior, the employer exposed employees to struck-by and crushing hazards while moving slabs of stones, in that an overhead crane (4000lbs. capacity electric crane) were not being inspected frequently. Employer's safety manual (page 50) states "The proper installation, operation, testing and maintenance of cranes and hoisting devices are a continuing responsibility of the owner/user. All hoists and cranes should be inspected per OSHA guidelines. This includes annual, as well as daily pre-use inspections. These should be documented, signed and dated".
