29 CFR 1926.501(b)(13):  The employer is failing to ensure that each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   (a) On October 4, 2023 and at times prior, where the employer does not require the use of fall protection during roofing work.  This violation was most recently observed at 400 27th Street North, Mandan North Dakota, where employees were not protected from fall hazards of over nine feet from the ground while employees were tearing shingles off a roof.  To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.  Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1587715, Citation 2, Item 1, and was affirmed as a final order on 05-24-2022, with respect to a workplace located at or near 4401 Elk Ridge Drive in Bismarck, North Dakota.   Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1557259, Citation 1, Item 1, and was affirmed as a final order on 04-01-2022, with respect to a workplace located at or near 1058 West Wood, Bismarck, North Dakota.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1554707, Citation 1, Item 1, and was affirmed as a final order on 04-01-2022, with respect to a workplace located at or near 201 Ashlee Avenue in Bismarck, North Dakota.

29 CFR 1926.1053(b)(1):  Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) On October 4, 2023 at 400 27th Street North in Mandan, North Dakota, for the employees exposed to hazards while ascending and descending a roof that is over 10 feet where an extension ladder extended 10 inches above the landing surface and was not secured or a grasping device provided.  Lolandiz Cunyas, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number1554707,  citation number1 , item number 1and was affirmed as a final order on 04-01-2022, with respect to a workplace located at or near 201 Ashlee Avenue in Bismarck, North Dakota.
