29 CFR 1926.501(b)(13): The employer failed to ensure that each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system:  (a) On July 8, 2025, at 2524 Stevens Street in Bismarck, North Dakota, employees were exposed to fall hazards of over 6 feet while installing roofing materials on a residential roof.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1529205, Citation 1, Item 1, and was affirmed as a final order on 06/29/2021, with respect to a workplace located at 1627 31st Street NW in Mandan, North Dakota.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1554707, Citation 2, Item 1, and was affirmed as a final order on 04/01/2022, with respect to a workplace located at 201 Ashlee Avenue in Bismarck, North Dakota. 29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) On July 8th, 2025 at 2524 Stevens Street in Bismarck, North Dakota, employees used a ladder that was set on the east side of a residential home to access and egress, the ladder did not extend three or more above the landing surface while installing/replacing roofing material and ridge caps.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1554707, Citation 1, Item 1, and was affirmed as a final order on 04/01/2022, with respect to a workplace located at 201 Ashlee Avenue in Bismarck, North Dakota.
