29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use:    a)  At Renaissance at Washington Ridge, 150 W 14th Street, Lakeland, FL:  On or about 10/4/2023, the employer exposed employees to fall hazards and struck-by hazards, in that, employees were lifted approximately 40 feet onto the roof of a building by a rough terrain, telehandler forklift in a field made wooden box which was not designed or approved by the manufacturer for such use.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a)  At Renaissance at Washington Ridge, 150 W 14th Street, Lakeland, FL:  On or about 10/4/2023, the employer exposed employees to fall hazards, in that fall protection was not provided to employees that were lifted on a scaffold supported by a rough terrain forklift to a 3rd story roof.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a)  At Renaissance at Washington Ridge, 150 W 14th Street, Lakeland, FL:  On or about 10/4/2023, the employer exposed employees to fall hazards of approximately 40 feet, in that, the employer did not ensure that employees used fall protection while they were replacing roof underlayment and shingles atop a three-story residential building.

29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  a)  At Renaissance at Washington Ridge, 150 W 14th Street, Lakeland, FL:  On or about 10/4/2023, employees were exposed to fall hazards of approximately 40 feet, in that a 40 foot Louisville portable aluminum extension ladder used to access the roof of a 3 story building was only extended above the landing surface approximately 20 inches and a grasping device was not provided to assist employees in mounting and dismounting the ladder.
