The employer did not develop and maintain accident prevention programs which effectively established, communicated, and enforced work rules for inspecting the condition of rigging materials, verifying that material was rigged to prevent unintentional displacement of a load, cordoning off hoisting routes and/or selecting hoisting routes which minimized employee exposure. The following conditions employees/sub-contractor employees to struck-by hazards from the load being lifted and a subsequent felled load event.

With the use of a tower crane, bundles of OSB sheathing were being offloaded from delivery trucks to the second deck of the structure.  The hoisting routes did not minimize exposure to employees who were utilizing a ladder to the second deck and working at ground level within the fall zone as the loads were being repeatedly lifted from the trucks to the second deck. The following condition exposed employees to struck-by hazards from the overhead loads and a subsequent felled load event.
